The Complaint Management Process

The Education Administration Act outlines the complaint management process once a complaint or employer report has been made about a certified Manitoba teacher’s professional misconduct.

Once an employer report or a public complaint is submitted to the Commissioner of Teacher Professional Conduct, the Commissioner will acknowledge receipt of the report or complaint and begin their preliminary review. Following the preliminary review, the Commissioner can decide to take no further action; conduct an investigation; and/or defer action pending the outcome of another process. The Commissioner may also investigate, on their own initiative, the conduct of a teacher if it is in the public interest.

When conducting an investigation, the Commissioner must give notice to the investigated teacher; the person who made the complaint or report (if applicable); and the teacher’s employer (if applicable).

Upon further review, the Commissioner can decide to take no further action or resolve the matter by consent resolution agreement or by ordering a hearing. The Commissioner must give notice of the hearing to the investigated teacher, and the person who made the complaint or report.

At any time after the Commissioner receives a complaint or report, or initiates an investigation, and while the outcome of proceedings is pending, the Commissioner may order the suspension of the teaching certificate of the investigated teacher if they consider it necessary to protect pupils from exposure to harm.

Consent resolution agreements, hearing panel decisions, suspensions and cancellations or limitations or conditions placed on the teacher’s certificate that result from the Commissioner’s reviews will be posted on Manitoba Education and Early Childhood Learning’s teacher discipline registry.
